Carolyn Sowell, individually, and as next friend of Clifford Brinson Sowell and Carolyn Sowell, minors, brought a petition against Marie Browning Sowell, and alleged: The petitioner was married to Harry M. Sowell on December 19, 1936, and Carolyn Sowell is the issue of such marriage. The petitioner and Harry M. Sowell legally adopted Clifford Brinson Sowell. The petitioner and Harry M. Sowell were divorced in November, 1947. The divorce decree awarded custody of the two named children to the petitioner, and provided payments for the support and maintenance of the children. Harry M. Sowell from time to time failed to make the required payments under the decree, and an execution was issued on the judgment on August 12, 1954, for $315, and the execution was duly recorded. This execution has not been paid or satisfied. After the issuance of the execution Harry M. Sowell failed to make further payments, and at the date of his death, on March 11, 1955, he was further indebted under the decree in the sum of $752.50. The defendant was married to Harry M. Sowell at the time the execution was placed on record. On August 16, 1954, Harry M. Sowell conveyed by deed certain described property to the defendant. This conveyance was without any consideration, and was made for the purposes and with the intent of hindering, delaying, and defrauding the petitioners claim under the court decree and the execution. The conveyance was made for the further purpose of removing the property beyond the reach of the judgment and execution. The purpose and intent of Harry M. Sowell was known to the defendant at the time the conveyance was made. After the conveyance Harry M. Sowell was less able to meet and pay the past and future payments required by the court decree and execution. "Petitioner alleges that the title to said property is legally in the heirs at law of Harry M. Sowell which petitioner Carolyn Sowell, minor, and Clifford Brinson Sowell, minor, are alleged to be." The property is subject to the lien of the execution.
