Mr. B. H. Bristow, for the plaintiff in error: 1. The first plea shows that Amy was not at any time the owner, holder, or bearer of any of the bonds or coupons. If he was not, he had no right to sue. He might have made out a prim a facie case by producing the bonds and coupons; but it was not impossible for the county to overturn the prim a facie case, and the opportunity ought to have been allowed on a trial of the issue.
